Este documento constituye un contrato de hospedaje entre el firmante al reverso y cualquiera de sus acompañantes (conjuntamente el "Huésped") e INMOBILIARIA KASAMARINA S.A. DE C.V. en su carácter de propietario. [Directamente o a través del fideicomiso respectivo) de THE REEF 28 (Ia "Propietaria"), representada por su factor mercantil (la 'Operadora").

 

  1. La relación entre Huésped, la Propietaria y la Operadora se regirá por lo previsto en el presente contrato, en el reglamento interior del hotel (el "Reglamento"), en el Código Civil para el Distrito Federal (el "'Código"), en la Ley Federal de Turismo y en el Reglamento de Establecimientos Hospedajes, Campamentos y Paraderos de Casas Rodantes.
  2. El Huésped, por la firma de este contrato y/o el uso de cualquiera de los servicios y/o instaIaciones que ofrece el hotel, acepta que queda sujeto a los términos y condiciones del presente contrato, al Reglamento, al Código y a las practicas y procedimientos que determine, de tiempo en tiempo, la Operadora en relación con el Hotel.
  3. El Huésped conviene con Ia Propietaria y la Operadora en que la responsabilidad civil de estas, de sus representantes, consejeros, funcionarios, empleados, agentes, filiales, accionistas, controladores y subsidiarios (conjuntamente, los "Prestadores") a favor del Huésped en caso de incumplimiento de obligaciones o de hechos ilícitos que le pudieran ser imputados los representantes no excederá del importe de la suma asegurada en el contrato de seguro de responsabilidad por daños a terceros en sus personas y bienes que la Propietaria y/o Operadora tienen celebrado conforme a lo ordenado por el artículo 71, fracción VI de la Ley Federal de Turismo y en el artículo 31 del Reglamento de Hospedaje, Campamentos y Paraderos de Casas Rodantes y NOM-07-TUR-2002. Así mismo, se convierte en que responsabilidad civil referida, sólo la tendrán los Prestadores si la misma queda cubierta como siniestro por el referido contrato de seguros y la compañía de seguros acepta la reclamación respectiva y paga, en caso contrario la responsabilidad máxima de los Prestadores no excederá de la cantidad de $500 US o su equivalente en moneda nacional, que las partes establecen como pena convencional. Consiguientemente, el Huésped renuncia a reclamar a los Prestadores cualquier otro daño o perjuicio no comprendido en este convenio sobre responsabilidad civil, a menos que proviniera de dolo de dichos Prestadores.
  4. El Huésped reconoce y acepta que terceros ajenos a la Propietaria, Ia Operadora o el Hotel como negociación mercantil ofrece bienes y/o servicios en el hotel o en la zonas aledañas al mismo, por Io que el Huésped acepta que los Prestadores no serán responsables en forma alguna por cualquier hecho o acontecimiento que se relacione con la adquisición de bienes y/o prestación de servicios por dichos terceros.
  5. En virtud de que el Hotel se encuentra ubicado en Ios Estados Unidos Mexicanos la prestación de servicios se hará de dicho territorio, e independientemente de cualquier oferta, publicidad o contratación que se haya hecho fuera de los Estados Unidos Mexicanos por cualquiera causa presente o futura.
  6. Este contrato se celebra en español e inglés, pero ambas versiones constituyen uno y el mismo contrato, en el entendido de que, en caso de que llegara a existir cualquier discrepancia entre dichas versiones, la versión en español prevalecerá.

 

ENGLISH

 

This document is a Lodging Agreement executed between the signatory in front and any of its companions (jointly hereinafter referred to as the 'Guest"' and INMOBILlARIA KASAMARINA S.A. DE C.V. (the 'Owner"). As Owner (directly or by means of a trust) of THE REEF 28 [the "Hotel'] represented by its mercantile agent (the 'Management Company").

 

  1. The Guest, the Owner and the Management Company agree to regulate their lodging relationships in accordance with the terms and conditions established in this agreement, in the internal regulations of the Hotel [the "Regulations"] in the Civil Code for the Federal District of the United Mexican States (the "Code"), in the Federal Law of Tourism, in the Regulations of Lodging Establishments, Camps and Mobile Home Sites.
  2. The Guest by executing this agreement and/or by the use of any of the services and/or installations provided by the Hotel, agrees to submit himself/herself to the terms and conditions of this agreement, to the Regulations, the Code and to the practices and procedures that the Management Company may determine from time to time in connection with the Hotel.
  3. The Guest agrees with the Owner and the Management Company that the civil liability in favor of the Guest by Owner, the Management Company, as well as that of its agents, directors officer, employees, branch companies, shareholders, holding companies and subsidiaries (jointly the 'Providers") in case any of the aforementioned persons infringe any obligation or perform any illicit act for which they could possibly be credited, their liability Will be only the amount covered by the insurance agreement for liability damages in their persons or in their property that the Owner and/or the Management Company have contracted in accordance with article 71, paragraph VI of the Federal Law of Tourism and article 31 of the Regulations of Lodging Establishments, Camps and Mobile Home Sites and NOM-07-TUR-2002. Furthermore, it is agreed that the referred to civil liability Will only be borne by the Providers if it is covered by the insurance agreement and if the insurance company accepts the receptive claim and pays, otherwise, the maximum liability that the Providers Will assume shalt not exceed the amount of $500 USD or its equivalent in Mexican currency with the parties hereto establish es contractual penalty for liquidated damages. Therefore, the Guest waives the right to claim to the Providers any other damage or injury not included in the aforementioned agreement of civil liabilities, except in the case of willful misconduct of the Providers.
  4. The Guest acknowledges and agrees that third parties other than the Owner, the Management Company and the Hotel as a mercantile negotiation may offer goods and/or services in the Hotel or adjoint site. Therefore, the Guest accepts that the Providers shall not be in any way liable for the acquisition of goods and/or services provided by such third parties.
  5. Considering that the Hotel is located in the United Mexican States and the service Will be rendered within said territory and not withstanding any offer, advertisement or agreement made outside the United Mexican States by any party, the Guest and the Providers for everything related the civil liability under this lodging agreement and the actions originating therefore irrevocably agree to submit themselves to the jurisdiction of the corresponding laws and courts sitting in the political subdivision of the domicile of the Hotel and they hereby waive their right to appeal to any others jurisdiction for any present or future cause.
  6. This agreement is executed in both, Spanish and English, but both versions should be considered as one same agreement, provided that should any discrepancy exist between the two versions here of, the Spanish version shall be the prevailing one.
